FHA After Bankruptcy: Start With the Right Date and Documents

Bankruptcy does not tell the whole mortgage story. The type of case, whether it is still active, the relevant court dates and your finances since the event determine what a lender needs to review. A filing date and a discharge date are different. A repayment plan is different from a discharged case.

Bankruptcy does not always end the FHA conversation.

FHA underwriting is not just a calendar check. Before relying on a simple “wait this many years” answer, gather the paperwork that shows what actually happened: the case type, whether it was discharged, dismissed or remains in repayment, and the dates the court records show. The discharge date, payment history since, credit rebuild, income, debts, assets, down payment, property and the automated or manual underwriting path all still matter.

HUD Handbook 4000.1 is the source document for FHA Single Family policy. This page summarizes the common Chapter 7 and Chapter 13 questions in borrower language, but the real file still has to be reviewed against the current handbook and investor overlays.

Bottom line: do not assume a prior bankruptcy means "no." Also do not assume the waiting period alone means "approved." The file needs a real FHA review.

Filing and discharge are different dates.

Imagine someone filed a case in March and received a discharge in November. Those are eight months apart. If a rule measures from discharge, counting from filing produces an incorrect readiness date. This example explains the paperwork issue; it does not establish a required waiting period or approve a loan.

A borrower in an active repayment plan has a different question: what payment evidence, court permission or underwriting review applies? Bring the plan status and payment history rather than estimating them from memory.

If a home was involved in the bankruptcy, explain what happened to the property and the mortgage. A later foreclosure or other housing event can require a separate review. Do not assume that one date resolves every requirement.

Chapter 7 and Chapter 13 are reviewed differently.

Chapter 7

HUD manual underwriting guidance says a Chapter 7 bankruptcy does not disqualify a borrower if at least two years have elapsed since discharge and the borrower has reestablished good credit or avoided new credit obligations. A shorter period may be reviewed only under limited extenuating-circumstance rules.

Chapter 13

HUD guidance says Chapter 13 does not disqualify a borrower if at least 12 months of the payout period has elapsed, required payments were made on time, and the borrower has written bankruptcy court permission to enter the mortgage transaction.

TOTAL Scorecard

For FHA loans run through TOTAL, HUD says the lender must document two years since bankruptcy discharge. If discharge was within two years of case number assignment, the file must be downgraded to Refer and manually underwritten.

What still matters after the waiting period.

The waiting period is only one part of the decision. FHA underwriting still has to answer whether the borrower can reasonably repay the new mortgage and whether the events that caused the bankruptcy are unlikely to repeat.

Credit after bankruptcy

Late payments after bankruptcy can be a bigger problem than the old bankruptcy itself. The file should show stable housing history, responsible credit use, and no unresolved derogatory items that block approval.

Income and debt-to-income

Income must be documented and stable enough for the mortgage payment. Debts, collections, judgments, student loans, child support, and other obligations still count where guidelines require them.

Assets and funds to close

FHA still requires eligible funds for down payment, closing costs, reserves where applicable, and any required payoff or resolution items. Gift funds may be possible if documented correctly.

Do not get tripped up by half-true FHA advice.

"Two years means approved"

No. Two years may clear one bankruptcy timing issue, but the borrower, credit, income, assets, debts, property, and underwriting still have to qualify.

"Chapter 13 must be discharged"

Not always. HUD guidance allows certain active Chapter 13 scenarios after at least 12 months of satisfactory payments and written court permission.

"All lenders treat it the same"

No. HUD sets FHA policy, but lenders and investors can have overlays. The specific lender channel matters.
